General

All offers, orders and agreements with Untamed Kombucha, located at Groeskuilen 118C, 5421ZW in Gemert, are subject to the terms and conditions of delivery. Deviations from these terms and conditions are only valid if agreed in writing.

These terms of delivery are available to all and can be found on Untamed Kombucha's website, and by consulting them, you acknowledge and accept them.

Inaccuracies

Untamed Kombucha takes great care to ensure that all information published on our website is accurate and up-to-date. However, inaccuracies may occur. Therefore, we cannot be held liable for damages resulting from inaccuracies, technical malfunctions or problems caused by or inherent to the dissemination of information via the Internet. This exclusion of liability also extends to affiliated companies and suppliers.

Offers

All offers from Untamed Kombucha are subject to change without notice. We reserve the right to withdraw offers at any time and all offers are subject to availability. Prices are subject to change at any time.

Returns

If you are not satisfied with your purchase, you can return unopened boxes or bottles to us within 14 days of receiving your order for a refund of the value of the returned items.You must ensure that the items are returned in good condition and you are responsible for the cost of return shipping.

Our prices are listed in euros and include VAT, but do not include shipping costs. Orders are shipped as soon as payment is received and the items are in stock.

Payments

All invoices must be paid by the buyer, using the method of their choice. Customers will receive an email confirming their order at the address they provided when placing an order through our website. If payment is not received by the specified deadline, we reserve the right to cancel the order or charge the customer legal interest from the due date of the invoice.

Delivery times and countries

We currently ship only within the Netherlands and Belgium. Orders placed before 2:00 pm and with items in stock are shipped immediately, otherwise they will be shipped the next business day or when payment or ordered items are received by Untamed Kombucha. If an order cannot be delivered within one business day, our customer service team will contact the customer to inform them of the status of their order.

If for any reason the agreed delivery period is exceeded by Untamed Kombucha, Untamed Kombucha shall notify the purchaser (by e-mail or telephone). In this case, the purchaser has the right to dissolve the agreement with Untamed Kombucha by notifying Untamed Kombucha in writing (by letter or e-mail).

Refund of payments

Any payments already made by the purchaser under the previous article shall be refunded to the purchaser's bank account as soon as possible, but in any event within fourteen (14) business days after Untamed Kombucha has received the request to dissolve the agreement as referred to in the above article.

All items delivered to the purchaser shall remain the property of Untamed Kombucha until all amounts owed by the purchaser for the items delivered under the contract have been paid to Untamed Kombucha in full. All items loaned to the purchaser are deemed to be treated with respect. In the event of destruction or damage, we shall be deemed to claim the full amount of the product.

Transport risks

The risk during transport of the product ordered by the customer is for Untamed Kombucha. At the time of delivery of the product, or the time that can reasonably be considered delivery, the risk of the product passes to the buyer, except for those liabilities that cannot be legally excluded by Untamed Kombucha.

Untamed Kombucha is not obliged to fulfill any obligation if it is prevented from doing so as a result of a circumstance which is not due to its fault, and which is not for its account under the law, a legal act or generally accepted practice. Such circumstances include, inter alia, a business failure, a failure in Internet connections, transport delays, a strike and non-delivery or late delivery by suppliers.

The customer should make a complaint to the above address. Untamed Kombucha will try to resolve the complaint as soon as possible. Untamed Kombucha will notify the customer in writing (via letter or e-mail).

Personal data

The personal data entered by the client will be included in a file. This data will be used for the execution of the customer's order.

This data may also be used to keep the client informed about Untamed Kombucha's activities and services. The processing of customer data takes place in accordance with applicable laws and regulations. Untamed Kombucha does not share personal data and takes measures to prevent third parties from having access to this data.

Copying information.

The intellectual property rights relating to the Untamed Kombucha website, including the software, search methods, texts and images belong to the Untamed Kombucha. You may not copy and/or edit any information without prior written permission from the Untamed Kombucha.

Promotion codes

Special action codes are often temporary and limited for larger quantities or resale. There are promotional codes that can be applied once per customer and/or order. These can be canceled by our staff at any time. Explanations of the action codes are visible on the website when they are active.

Ownership

Buyers and visitors of Untamed Kombucha's website must fully and unconditionally respect all intellectual and industrial property rights vested in the services and products provided by Untamed Kombucha.

Reports of errors and/or defects in an order should be reported exclusively by e-mail and within 14 days after receipt of the order, reports will be checked 100%.

Dutch Law

All offers, orders and agreements of Untamed Kombucha are governed by Dutch law. All correspondence under these terms and conditions shall be with Untamed Kombucha, Groeskuilen 118C, 5421ZW Gemert, info@untamedkombucha.nl.
